Regarding 4.33 download links and related site content changes

For sure not all of us have a clear picture of what is going on. Nevertheless I cannot hide my frustration for the unfair gameplay from the new owners of Falcon 4.0 end. After almost 2 and a half years being the new owners the chose this moment (just after the 4.33 upgrade) to raise whichever claims they are entitled to. Yes I know the whole world is unfair…
You concede that we dont know the picture of what is going on, but you automatically assume that this constitutes foul play by the owners of the IP. Lets perhaps wait for more concrete information before concluding that contact from the owner of the IP is unfair gameplay?

I do not come up with any conclusions. I just expressed my frustration. I hope that I do have this right to express my feelings among friends and team mates.

Its less about the frustration and more about the accusations of unfair gameplay. Kinda the thing I belive boxer was explaining that would hurt rather than help.
I can appreciate your frustration and fears of interference with BMS’ availability, but I think its the kind of thing that could hurt more than help.

So it has written before but you’re talking and talking. Obviously, here, we are all fans and guests of BMS.

I’m so glad that I made a backup copy of both versions. And i will definitely keep them in a safe place. I think that it’s really fracked up what they’re doing.

what is really fracked up is people buying something and using some legal trick to get refund and still using the product.
did i asked refund of my falcon 4.0 Cd after installing it ?

I do not normally share my opinion on open forums as there is always a risk of being trolled (no I do not mean you guys - present company is excepted )
However I must say that I am disappointed that this thread continues, as some of the comments made are at best unhelpful and at worst could even be potentially damaging. The thread is full of speculation and paranoia.
No doubt the new owners will be paying attention to our forum and some of the emotional posts I have seen made could, however unintentionally, be interpreted as veiled threats and threats are never going to result in a positive attitude or outcome from the new owners.
The new owners after paying good money will have wanted to protect their IP and will have started a process of forensic analysis of the internet to see what is out there and to remove routes for unlawfully obtaining their IP and correcting inconsistencies in other websites regarding names so that they are able if necessary in the future, to demonstrate the ownership of that IP in the event that somebody is trying to obtain or use that IP unlawfully (e.g. by someone claiming that they genuinely believed that the owners are still Atari).
It is entirely possible that it was the release of 4.33 that flagged up BMS on the owners radar but also feasible that we were not on their priority list - they would have wanted to shut down unlawful sources of IP copies first to immediately protect their revenue.The fact is that the new owners have invested in the IP and are free to do whatever they want with it and as has been commented several times in this thread, we should let our BMS Developer friends and their colleagues get on with the sensitive topics with the new owners without BMS having to worry about an enthusiastic forum member saying the wrong thing before a moderator can catch it.
It would appear that enough has been said already in this thread so I would strongly suggest we slam the airbrakes on this thread immediately (probably there is a better aviation analogy I could have made but I think you get my intended message )

That’s not helping! Apparently too many of you here are noobs. Those of us that have been around have been through F4 “dying” at least once now that things will work out (some of you that have been around have forgotten). You all need to chill!
The worst thing that could happen right now is the IP owner come into this thread to check that the downloads were shut off as a sign of good faith from BMS as tgey neogiate and see you all losing it (and I honestly want to add some letters to the “it” with a your in front)
If BMS says they expect things to work out I believe them. And that us probably the most optimistic I’ve ever been going into one of these situations (and I’m a pretty pessimistic guy most of the time)
Never in the history of Falcon 4 has a mod group have such a good platform to convince the IP holder why they should stay.
1. Old hard copies are rare, meaning more people out there to buy their product (and why the quoted post is not helping)2.BMS is now so far advanced from the original product that it can only drive sells, linkbacks to the distributors’ here and theready to here would only help both of us. We always get people saying I need an F4 copy and on their side you are buying retro product with the whole history of the series with the option to try the modern up to date mod.
3. They own other IP that a lot of us would buy due to the retro angle as I mentioned in the previous post. I’ll even buy some of the titles I already own again if they have a trouble free way to emulate DOS/old versions of Windows because I don’t want to spend hours just packing to go on a trip down memory lane like I seem to have to do now.
There are only two ways this ends badly for us is A. If we ruin it by talking smack that makes the IP owner think the community can’t be worked with and B. they see dollar signs and try to somehow force to take the community’s work to sell (which most of it in the long run would still be on shaky legal ground to take). And a lot of A. might lead to them trying B.

I am posting this snippet from the first post by the op:
We are discussing this and related licensing issues with the new owners and we hope to have a resolution satisfactory to all shortly. In the meanwhile the owners of Falcon 4.0 have asked for removal of the links to the 4.33 installer and also to correct any statements in the web site here that incorrectly state ownership of Falcon 4.0. The BMS group is cooperating with those requests in service of reaching agreement with the new owners.
Why anyone is putting any blame or nefarious intent upon the new license holder is beyond me. Gentlemen, they seem to be ensuring that their rights as owners are secure.
My suggestion is to honor the OP’s request and have some patience until the issues are resolved. IMHO, discussion between BMS and the new owners is a good thing. Much better than us discussing things we have no knowledge of.
