Pictures from BMS manuals in internet videos.
-
Hello everyone
I have already made more than a few videos and published on the web. At the beginning of my work I was incompetent about copyrights, but now I know I should give something from myself in films (I think so happened that not everything is translated and performed directly, in the same way). So I checked my videos If it has figures from manuals…
I can immediately remove the films that contain such content.
I would like to know If I could use those pictures, also in future vid (I don’t earn money from this, and I know it’s forbidden to do so in BMS U1)? And what about Allied Force manuals? Should I ask Lead Pursuit…?
Thank you in advance for your answers.
Salute.

Under Australian law (I make no statement here about the applicability of Australian law to your circumstances) making use of small sections of copyrighted works for educational purpose is protected by law, under the Fair Go section of our Copyright Act. I understand US law has a similar Fair Use section in their law. Its commonly held that such usage is not an infringement of copyright. However, that depends on the nature of your reproduction. If you are just copying the manual page for page into your video, hundreds of pages, that is not a small section. But copying for instance, diagrams is not an issue (in Australia at least).
If you can find the same diagrams in US government produced manuals, you are luck - as they automatically are not copyrighted.
-
How do I know if it is US government produced manuals picture? I searched in BMS documentation and not found any words like ‘government, united states’.
-
No, I meant if you wanted to use diagrams from such manuals in your videos, you wont have to worry about copyright - just the arms export control act.
I have not exactly tried cross referencing the BMS manuals diagrams, but I imagine they are mostly produced by the BMS team. In which case specific countries laws vary, but limited reproduction is generally permissible.

Ok I understand that I can use BMS pictures but not to exaggerate.
Many thanks Blu3wolf -
Spatek,
Better to hear the answer from the horse’s mouth rather than to rely on outsider’s answers
Above the legal aspect, we appreciate the fact that you ask permissions to the team to reproduce some pages in your videos.Except a few graphs and illustration, most the BMS manual pictures are from the BMS team. We appreciate they are not changed or put out of context but you’re free to use them in your BMS videos, No problem with that.
Just one thing, the -34 wasn’t overhauled yet as we want it to be, and image control on that manual wasn’t as thorough as on the other ones, so I would give you permission to use the BMS pictures from the trainingmanual, bms manual and dash1 but i would not use dash-34 pictures as long as we don’t have overhauled it
it is a document that was written by many different ppl and we need more time to reorganize the way we wantagain, thanks for asking

Keep going Red Dog, it’s a high quality work, very enjoyable to read!

Great to hear the ethical answer rather than just the legal answer. There is what you are allowed to do, and then there is what it is polite to do. Glad to see they both align here.

Sorry that I didn’t turn to you Red Dog, but I thought Blu3wolf is related with you.
What should I do to get that permission?
-
I gave you the permission
-
If i were able to offer such permission on behalf of the BMS dev team, I would not need to make reference to copyright law, now would I?
Glad that’s sorted.

your intervention Bw made it sound like you were de facto authorizing him to proceed, although you have no link to the BMS manual team
It would be best to leave these answers to the guys who are concerned with the question. You were notThat would avoid confusion in these matters
I’m not answering questions aimed for you. proceed the same please

Rereading my responses, I have to disagree that it appears to be a de facto authorisation. Legally, there is no question about authorisation - it exists, regardless of the dev teams position on the topic. Ethically, it is much better to have that permission.
The topic was not directed specifically at anyone. Were that the intent of the poster, it clearly would have been labelled so. Speaking on the topic of copyright, that leaves it quite clear. I even went so far as to make specific reference to the appropriate sections of the laws covering such copyright.
I can only blame this interpretation of my words as being a grant of permission I am unable to make, as being due to language difficulties.

Care to share the link to these vid’s?

The best and easiest way to feel purely was asking for permission and I wanted the answer someone from BMS team. I thought that it would be clear if someone who answers such question, must be authorized. It can be my mistake because of I didn’t make sure who is who or it was just misunderstanding from my side @Spatek:
Ok I understand that I can use BMS pictures but not to exaggerate.
(but then someone would deny if it was?).
I don’t have bad intentions!
About the link to the videos… I was going to upload tomorrow corrected film, because of pictures. I hope it’s only one…
But if you want now…? -
Being a video junkie… absolutely!
