Falcon BMS 4.33 copyright issues

Hello, I would like know if Falcon BMS could become a project Standalone like Project Reality (Battlefield 2), Dark Mod (Doom 3), Renegade X (Command & Conquer), because it does not need Falcon 4.0 to play. Falcon BMS 4.33 has a more modern graphic engine and different from Falcon 4.0 original. This could help solve copyright issues related to Falcon 4. Please excuse my English, I am Brazil.
