Sim using BMS?

Some of the gallery images look a lot like BMS.

The Simulator page lists the software as:
Benchmarx Falcon 4.32
It must be a misspelling of Benchmark.Neat idea…I wonder if it’s worth the ~$150.00 an hour.

Reminds me of Flightdeck in Los Angeles, CA.

£99 for an hour of sim time? What exactly are they offering?
-
Since BMS is now no longer for commercial use, would this be illegal? Or does it not apply to 4.32?

I think this is clearly commercial use.
-
…those screenshots don’t look nearly as good as BMS. FAF maybe? Maybe…

The Benchmarx 4.32 as opposed to actual Benchmark 4.32 is deliberately done.
Not sure if the new deal with Tommo can bring about any indictment, I guess they are charging for the cockpit box ride.
Somewhat wrong to make money off what is meant to be free IMHO.
Amount charged for an hour ride is pretty steep. -

Amount charged for an hour ride is pretty steep.Yeah, but they are not necessarily charging for the sim, they are charging for you to use their cockpit. Which they did spend money to create.

However, the use of BMS in a commercial environment I believe would still be against the new agreement regardless of if they are only charging for the time spent in the cockpit.

I agree, X-Plane does the same. You have to purchase the commercial version to use it in commercial applications.

Would suck to drop the money to hop in the pit only to realize you could have just gotten the sim on your own home PC for only a few dollars (not including a basic flight stick). Kinda seems like a punch in the gut knowing that some guy is profiting off of many good peoples hard work that they did for nothing.

I doubt a lot of people has the money to drop on a network of Pits… but yes its definitely a commercial use, up to Tommo to enforce it or not i guess

I don’t think they are using BMS…if you look at the Gallery shots the first thing you’ll notice is that the HUD glass edges fall outside of the HUD supports…and that the graphics in general are way below the quality/standards of BMS. So unless this could be proved to be a very old release of BMS, I seriously doubt that it is BMS that they are using. It just flat doesn’t look as good as BMS.
I could see it being ginned up from Prepared3D, though - the commercial/pro version. But even so, with some outside development.

From Boxer’s explanation of our agreement with Tommo :
You will note from this that the Falcon BMS community add-on is made and distributed with permission from Tommo. That permission is conditioned on the install and runtime checks mentioned above as well as reinforcing that, in line with the BMS team’s long-time policy, Falcon BMS is only available for non-commercial uses.
From the end user license agreement :
You, the end-user, are granted non-exclusive, non-sublicensable rights to use the product for personal, non-commercial purposes only. You may not alter, transfer, modify, incorporate into or with other software or create a derivative work of any part of the product software without prior permission of the original author or license holder of that part. No ownership rights to the software and documentation are transfered to you. You may not use the software for purposes other than for which it is provided. You may not remove any proprietary, copyrights, trade secret or warning legend from any part of the software or documentation or copies thereof.
[…]You represent and warrant that:
You will not use the files in any way that is not permitted by this Agreement;
Your use of the files will not violate any applicable law or regulation of any country, state, or other governmental entity. This is a commercial use of BMS, that is against the terms of the license agreement , as well as against the long-term interests of BMS.
As a result, I’m closing the thread and editing the links. Thanks for understanding.
