So the Rafale is copyrighted, but the Mirage 2000 D especially the N is not ? the - 5 …. 2000C RDY ? EGM ? … i can understand their concerns,but i find it a bit harsh.

I do not know … but I wouldn’t ask them
IMO … Rafael is just more “sensitive”. That’s all.

IMO … having the 3D model is not problem… but make it flyable with 3D cockpit, I do not know. (?) -

Since BMS is free mod, there should not be any issues with copyrights.
I remember way back when Counter-Strike first started as a free mod for Half-Life and they had all the real names for every gun. But from one point it started to become payable or something so they changed all the names for the guns with fictional ones

Absoluetly not. It has NOTHING to do with money. (Dassault is not making money with video game simulator nor Rafael marketing.)

Dassault does have reasons to keep the technology very closely guarded. Much like our F22 or F35 here in the states

Good morning… actually that is / was and has been the case ever since. Every design is copyright protected by it’s designers unless he/she declares it otherwise.
You may find racing simulator where a Mercedes AMG is named Mecator AMB or something like that. That’s the case, because the game producer have not licensed the cars from the manufacturers.
The same applies to Flightsims. Strictly spoken one would have to ask each manufacturer for permission to use the aircraft in the sim.

That’s certainly not an issue - for as long as you don’t use classified data for your flightmodels, radar-capability, RWR, etc. The outer 3D design of the aircraft can be seen and photographed in every detail on numerous locations. It’s not exactly like they are hiding it and wrap a towel around it e.g. at airshows. As with most publicly know military aircrafts, it’s not the hardware that is classified, it’s the software.
There are exceptions to that though, e.g when it comes to the cockpit: E.g. there is no cockpit picture publicly available for the Tornado ASSTA 3 upgrade, because it’s still classified atm. So if you would be able to sneak a cockpit picture somehow/somewhere it obviously would be a no-go to build a 3d pit from that. -

If they had Dassault’s auth. wouldn’t they have a nice big seal on it somewhere like the Air Force does?
I would be interested in developing a 3d cockpit if the BMS community stood behind it, looks like the 3d model is around but we do not know if Hyab will release for any reason.

BMS already has Mirage F1, 2000, and previously super etendard and Rafale (free falcon). Who cares about Dassault?

I just know some ppl from the DGA (French Armament Agency) who gaves me info about that. But can’t tell you more sorry. The only thing that I say if that they may (or may not) takes legal actions (I didn’t asked them how) to anyone is trying to repro some Rafael stuff (except body shapes … it seems that they do not care that much! … not the same for cockpit and avionics design).
EDIT: And they are actually reading those lines.

What is the point to making the DGA come here, i mean what is the point to talking with DGA guys about that? Except attracting problems about this topic, did the DGA don’t have more importants things to do instead of coming here? For what? Checking if a Rafale is not made for a videogame?! There is already a ton of Rafales just being modelised in many games. I don’t understand why it should be a problem on a sim like bms who using F16 avionics (it’s not the Rafale at all) to reproduce this baby which in all case never gonna be like the real one, and the Rafale from FSX was a payware so it’s a totally different thing. I really think that rather than talking about this kind of things, we should continue to encourage Hayab for his amazing work!

I do not believe that Dee-Jay caused them to “come here,” but rather that they are looking at sites like this and similar sites where their Intellectual Property might be used.
In answer to your question of what is the point: IMO, the point is that Dassault owns the rights to their stuff and can do what they wish with it. There is some leeway regarding “fair use,” but releasing something may ultimately lead to legal action such as a cease and desist – even if it is not a “for profit” item. Does it seem fair? Not really to me because, as you say, there is currently no way to faithfully reproduce the Rafale anywhere near as faithfully as the F-16 is currently modeled, but it is their prerogative to monitor their IP.
Just my 2 cents.

Fighter procurement is politics, and Dassault Aviation needs to do better to sell more of their eminent fighter. If the different fighter consortiums were smart, they would push their unclassified models and data into the major flightsims. They would be surprised of how far their product information could reach…
