      Apparently, there’s a Chengdu J- 10 for Falcon BMS at some stage of development or even finished… since the avionics package of this fighter appears to be rather similar to that of the F- 16, and the conclusion can be drawn by watching this video:

      a unique opportunity presented itself to fly a red fighter which is modeled almost properly. I did a search here on the forums, but it came up empty regarding the J- 10. Does anyone know anything about this mod?

              It would not matter if there were or not. Intellectual Property rights are automatically conferred upon the creator of the IP, at least in the U.S.

                  No,not necessarily. Copyright does not require registration …. the act of creation confers copyright.

                  For trademarks, trade-dress, service marks, etc. there is the concept of ‘first use’ (which has an analog for patents, i.e. unique inventions) and has to do with who can show the earliest use or adoption of a particular trademark or service mark and those do require registration (i.e. suchandsuch is a registered trademark of the whatever corporation).

                  Things such as 3D models and software/programming, as far as I know, are typically considered copyrightable materials.

                      Registration allows for an increase in standing in the case of an infringement claim, but is not necessary in order to claim a work as protected.

                      Also, the mere act of registration is not ‘proof’ of ownership; it’s proof of registration. As you stated, you could register my work and claim ownership. That doesn’t make your claim true, nor does it make you the owner.

                        That doesn’t say much. In a court the judge will decide. There must be proof and etc also there are territorial issues and so on and so forth which doesn’t lead us anywhere unless we all are lawyers on IP rights.
                        Ok so in BMS case how is this proven?
                        One now offers something. we see the same from a store or another community that looks the same… well it’s a cockpit all cockpits are the same… but yes the details prove it. The shop sells the thing and in many times those are leaked so one can find download the model or buy it and use it.

                        If one buys it is it ok?
                        if not then there is a problem.

                        Next is looking at the details and find differences or similarities that prove the “copyright” thing.

                        Doing so one has to have both in hand, if you have pictures from the one and the model from the other, I must say this is not accurate enough which ends up on deciding by heart… or belief.

                        So if BMS want’s to be clear those must be created by team members where they have a constant periodical interference thus originality can be proven by wip and actual contact with the creator.

                        Getting whatever is outside the team there will always be a bit of: “well something might not be right here…”

                        and once more this should go down to the tools and programs used for doing so… cough cough…

                          It depends on the condition of the sale. If the sale allows for unlimited use in any situation, then clearly yes. However, that is not often the case.

                          Next is looking at the details and find differences or similarities that prove the “copyright” thing.

                          Correct, but I believe that for BMS, securing the rights from the “creator” should be sufficient. If the “creator” is suspect, as I noted has happened on more than one occasion, then it is up to the “creator” to show provenance.

                          My guess is that if provenance is questionable, BMS will likely pass on its incorporation into the install.

                              Maybe there are plenty of that kind of cockpits and planes around and never showed. Created just for personal use by 3d modelers. It’s another case 🙂

                                  I disagree. I have seen examples of work that the public has contributed be incorporated into BMS.

                                        Back to the subject of this topic it’s quite singular that in an open project like BMS no one talk or introduced this mod b4. and been accidentally discovered. May we have a parallel chinese Falcon 4.0/BMS?

                                          Many projects and stuff are done like that. This is to the creators discretion, so if he want’s he says it if not you - we will discover those accidentally. Some are banned and still work on some projects. Some are in closed groups for squadrons for example that you might never find about and if we are lucky we might see a public video only.

                                          some maybe the creator builds them just for him self… you never know.
