Regarding 4.33 download links and related site content changes

Under the EULA you agreed to when you purchased Falcon 4.0, they dont actually have the right to end your license to use Falcon 4.0 arbitrarily.
There is no way for a ‘you have to buy it again’ to come about. This is just borrowing trouble.
That’s not my question since I can and will use the mod no matter what anyone says.
Distribution is another matter.
My concern is how this could affect public online groups like FO.

The IP holder does not have the right to make the use of BMS unlawful. They have the right to make its distribution unlawful, but copyright has no hold over the ability of an individual to modify a work for their own personal enjoyment.
That’s not my question since I can and will use the mod no matter what anyone says.

Under copyright law, so long as FO doesnt distribute copyrighted works, or works based on others IP, there is nothing they can do.
Im not really clear on the provenance of the FO theaters, but I assume they are their own work and not based on stock KTO that came with F4.0 so it doesnt matter.

I believe someone told them if we (I mean the BMS team mostly and the community then) don’t “be” or provide our MOD then they wouldn’t sell anything regarding Falcon 4.0.
So removing the BMS download links reduces their clients…I would ask them if they want to put a link to BMS download and some pics… and yes it will be free and yes they can say if they want that FreeFalcon existed.

I hope to hear good new soon. I belive BMS will solve this issue again as it did before. I agree Arty’s comment about removing BMS download link.
BMS is a reason why Falcon 4.0 is still alive. That could sound odd but that’s true -
I really appreciate the transparency and straight forward approach. I was wondering why the links were down, but now this makes sense. It seems to me it’s an matter of pride for the business involved judging from what l3 originally posted and they just want their name on it, less that they want to stop this community. It would not be in their benefit imho and we know its 20 year obsolete code (compared to modern method) and isn’t as valuable without BMS hand in hand. I look forward to hearing good news, thanks for the info!

I think everyone should perhaps take a pause and let the on-going conversation reach a conclusion. Not having an instant answer is always tricky in venues like this that live on “internet time” but please remember there are real world participants in reaching resolution for the present situation who work on a more normal Mon-Fri/9-5 commercial schedule. Speculation, hypothetical projections for the future, editorializing on the situation or participants without full information…well none of that really helps and it could impede a favorable outcome. It’s important to remember that this is a public venue and everything you write here can, and you have to assume that it may well be, taken out of context elsewhere; this kind of thing can have alarmingly severe consequences in some cases [taking no sides in or position on that case, just sharing an example of the kinds of unintended consequences that can accrue from off the cuff remarks made in public].
I’d like to make a personal plea that we all have faith that the present conversation will reach a favorable outcome for our hobby and that everyone assume good intentions on the part of all the participants in the discussion.

Well, seeing dl links removed I was secretly hoping in U1 release preparations but I believe that BMS amazing team can solve this issue to both sides win solution.

Ya know, if you think about it, if BMS did not exist, they probably would have never purchased the rights to Falcon 4.0. Why would they purchase something that is out of date and useless without your wonderful updates. Stick to your guns. Don’t take no crap. And if you need back up, I will be there “armed and ready” as we say before takeoff Seriously, I have full confidence in you fellers. Go get em boys! Fox One!

Given that they bought a whole heap of other IP at the same time, and started putting it onto GOG, Steam, etc… Id say that BMS was not a factor in purchasing the F4 rights.
If it had been, they would have sold F4.0 separately from the get go, rather than as a bonus with F3.0.

I surfed over to the Graphsim site the other night and the only game they are currently advertising is a version of Hornet for iOS…so it looks like they sold off or otherwise retired every game title Graphsim held previously. That was a bit of a shocker.

I never really looked into their other titles. I thought Graphsim mostly just did AF?
What other titles did they used to sell?

They had FAF, Hornet 3.0, Hornet Iraq, a couple first person shooters - at one time they were even an X-Plane retailer…quite a list, really. Now those are all disappeared.
I also noticed that the Apple App Store has taken down the OS X version of FAF…because I bought it I still have it available for re-download, but if you go searching it’s no longer listed.

For sure not all of us have a clear picture of what is going on. Nevertheless I cannot hide my frustration for the unfair gameplay from the new owners of Falcon 4.0 end. After almost 2 and a half years being the new owners the chose this moment (just after the 4.33 upgrade) to raise whichever claims they are entitled to. Yes I know the whole world is unfair…

You concede that we dont know the picture of what is going on, but you automatically assume that this constitutes foul play by the owners of the IP. Lets perhaps wait for more concrete information before concluding that contact from the owner of the IP is unfair gameplay?
